Terms and Conditions

These terms and conditions govern your use of our website and particulars of sale. Please read these terms in full before you use this website or place an order. If you do not accept these terms and conditions, please do not use this website or place an order till you understand and accept the points below. Your continued use of this website confirms your acceptance of these terms.

Website access

1.1 It is not necessary to register with us in order to use most parts of this website. However, particular areas of this website will only be accessible only if you have registered.

Use of website

1.2 This website may be used for your own private purposes and in accordance with these terms and conditions.

1.3 You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.

Website uptime

1.4 All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.

1.5 Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.

Visitor provided material

1.6 Any material that a visitor to this website sends or posts to this website shall be considered non-proprietary and non confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy.

1.7 When using this website you shall not post or send to or from this website any material:

(a) for which you have not obtained all necessary consents;

(b) that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the United Kingdom;

(c) which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.

1.8 We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of Paragraph 1.7.

1.12 Whilst we do take all reasonable steps to make sure that the information on this website is up to date and accurate at all times we do not guarantee that all material is accurate and, or up to date. This particularly applies to quoted ranges which are estimated typically obtained by using the bike at a minimum speed and are in no way guaranteed.

1.13 All material contained on this website is provided without any or warranty of any kind. You use the material on this website at your own discretion.

Exclusion of liability

1.14 We do not accept liability for any loss or damage that you suffer as a result of using this website.

1.15 Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United Kingdom.

Delivery & PDI

1.16 Your order will be processed and delivered without undue delay, no later than 30 days after your motorcycle or moped has been registered unless otherwise agreed between yourselves and us.

(a) PLEASE NOTE. Delivery by us is likely to be scheduled in with other deliveries and tasks but we will endeavour to do this in a timely manner. However, the most expedient way to receive your bike will always be to collect it. Please also note that some deliveries could be made by riding the bike to the delivery address on Trade Plates.

(b) The bike will have a Pre-Delivery and Inspection and road test. This means that no new vehicle will come to you with 0 miles. This does not affect its right to be registered as new and you as the First Registered Keeper.

(c) Some manufactures provide Apps for monitoring of the vehicle. Due to Privacy concerns we will not test this as part of the PDI process ourselves but will show you how to set the App up if requested. Please note that the function of the App is controlled by the manufacturer and hence we will have to rely on them to resolve any issues with connectivity to the App. We will endeavor to do so as soon as reasonably possible.

Collection

1.17 You many chose to collect your vehicle if you wish. In this circumstance, any liability for loss, damage, traffic offences etc on Green-mopeds.com Ltd will cease from the moment you start the vehicle yourself. In addition, you are responsible to provide insurance for the collection process and any necessary L-Plates etc if required. (We are happy to help you fit them).

Cancellations, returns and refunds

1.18 All customers have the right to cancel their order under the Consumer Rights Act 2015 regarding faulty goods. However specific provisions apply if you simply change your mind which are specifically related to Motor Vehicles under the Act. Please see 1.2.2

1.19 Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods with the exception of clause 1.24 below

1.20 To meet the cancellation deadline, please notify us via email or phone about cancelling the order before the cancellation period has expired. Please see 1.24 below

1.21 If you are in possession of the goods prior to the completion of the registration process, you are under the duty to retain them and take reasonable care of them. You must return the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged) as soon as possible once you have cancelled the order.

1.22 If you change your mind, we reserve the right to make a charge of our direct costs of recovering the goods if you do not return them yourself or we collect them at our expense. If the vehicle has been registered, we also reserve the right to charge for the loss of value of the goods because it will have a "previous owner" on the V5 which will impact our ability to sell this vehicle on which is typically 15% of the value of the vehicle. Please note that this applies even if the vehicle has yet to be collected or delivered. If there has been any use of the bike and marks or damage to any of it, additional charges including the labour to rectify them will be added. For the avoidance of doubt, this provision is explicity allowed under the Consumer Rights Act 2015 with regards to Motor Vehicles. 1.23 Once you have notified us that you wish to cancel the order, any sum debited to us will be refunded to you as soon as possible and in any event within 14 days of your cancellation less any costs associated with clause 1.2.2 above. Please also see 1.24 below

1.24 You will not have any right to cancel an order for the supply of any of the following goods:

(a) for the supply of goods that are made to the customer's specification or have been personalised or modified or have been repaired, vandalised or have had a warranty claim against them

(b) combine goods with other goods after delivery so that they become inseparable.

(c) break any warranty seal of any batteries or components with a seal applied or tamper with them in any way.

(d) used the bike more than 10 miles which would be adequate to test it.

1.25 At our discretion usually due to unforseen circumstances, we have the right to cancel an order and refund your money. Examples include, excessive price increases, cancellation of models, ending of Agreements with importers etc

1.26 Refunds

Before a bike is ordered from our suppliers, we require a deposit to be paid. Once the vehicle arrives with us we will request the final payment of the remainder outstanding. If the order is cancelled between delivery to us and final payment, you will receive a refund of your deposit with the following exceptions.

(a) A custom made bike. For example a bike that has a specific feature or colour.
(b) A bike made to order. This is currently Askoll, ECCity Motorcycles and Macrais.

(c) A Registered bike in your name. Please see 1.22

1.27 Pricing and Quotes

We will provide quotes and invoices as part of the sales process. We will of course endeavour to provide these in a timely and accurate matter. However errors and omissions are accepted. PLease also note that quotes may have to be revised based on unforseen circustances arising from work being done. We will inform you of those changes before commencing.

1.28 Warranty

Many of our bikes come with a warranty associated with the Plug-in-Motorcycle-Grant. This terms governing this Grant can be found here. https://www.gov.uk/government/publications/plug-in-motorcycle-grant-eligibility/plug-in-motorcycle-grant-eligibility

Please note the following points concerning warranty.

(a). The warranty holder is the Importer not Green-Mopeds. They importer ultimately decides if Warranty claims are accepted and Green-Mopeds will work with the customer to obtain a satisfactory claim.

(b) The meet the Warranty terms there maybe conditions and requirements placed upon the owner. For example, regular maintenance or servicing requirements described in the manual. It is the responsibility of the owner to understand those terms as specified in the User Manual or as specified on the Manufactures/Importers web-site.

(c) If the vehicle owner does not follow the guidance in the User Manual, neither the Importer and/or Green-Mopeds are under an obligation to support your Warranty Claim.

(d) Different Importer/Manufacturers have different rules governing when the Warranty starts. Some state delivery date, some state registration date. Please check with us if this is a concern.

(e) There will be exclusions such as Tyres, Brake elements (pads and discs etc) and other consumable items. Please check your manual and/or request the specific Warranty terms associated with your bike to understand what is covered.

(f) Ex-demo/used bikes may not have a Warranty at all or only a residual term left from the initial delivery/registration date. Please check with us if this is a concern.

(g) For Warranty Claims. If work is required, the bike needs to be returned to Green-Mopeds at the customers expense unless a Breakdown/Recovery service has been included in the Purchase price (eg Artisan, Horwin, Silence and Niu). It will be returned to the customer at Green-Mopeds expense or can be collected. While some importers offer breakdown cover in the price of the bike, many do not so customers are advised to purchase cover such as RAC, AA etc to deal with this eventuality. Warranty cover does not imply breakdown cover or recovery unless explicitly provided by the manufacturer.

(h) De-restriction. Certain brands including SurRon (Road-Legal version) , Yadea G5 and Impulse and the Super Soco (TS, TC, TSx & CUx) have controllers that can be de-restricted to enable full power and hence higher speeds to be achieved. If a customer chooses to de-restrict their bike, Green-Mopeds accepts no responsible or any liability resulting from this action, including but not limited to:-

(i) Particular attention should be paid to the care of the bikes batteries. Manufacturers state in the documentation how to take care of the batteries including regular charging even when the bike is not being used, long term storage and cold weather care.  Unfortunately the batteries will not be replaced if these procedures are not followed and the batteries fail.

i.Loss of Insurance cover
ii. Fines/Penalties or other legal infringement from not having the appropriate License for the category of class the modified bike becomes.
iii. The Manufacturer/Importer withdrawing Warranty Cover

1.29 Pre-Owned Bike Section

(a) Green-Mopeds lists pre-owned bikes on behalf of customers or anyone wishing to sell their electric moped of motorcycle. As part of this process, Green-mopeds may or may not receive a one-time listing fee to do so. While we endeavour to obtain, complete and accurate information on the vehicle, once the buyer is introduced to the seller, they are encouraged to ask all necessary questions to make an informed decision on the purchase of the bike.

As an introductory-only service, Green-Mopeds accepts no responsibility whatsoever for the contract made between the buyer and seller especially as Green-Mopeds does not receive any money for the sale of the vehicle which is negoiated directly between both parties.

Buyers should confirm all information necessary to ensure they are happy with their purchase such as ownership, condition of the bike, faults, damage, warranty, existing finance, ability to obtain parts, insurance, tyres etc and any ability to return the bike to the Seller (not Green-Mopeds) if they are not satisfied. We are happy to provide advice on this if required without accepting liability for any such purchase made.

For the avoidance of doubt, any faults, outstanding finance, claims or damage that is found on the bike by the buyer at any time once received is solely the responsibility of the seller NOT Green-Mopeds.

(b) Note to Seller. Please note that any fees paid to list your vehicle is non-refundable.

(c) Ex-demo bikes listed in the Pre-owned section are bikes that are sold by Green-Mopeds and as such, normal terms and conditions of sale apply to those bikes.

1.30 Free & Special Offers

From time to time, Green-Mopeds.com Ltd will run Promotions and Special Offers, including but not limited to free items with purchases. Each promotion will include specific Terms and Conditions. However in general, the following points are made.

(a) Free offers will have no alternative monetary value. Ie the free item cannot not be replaced by a monetary discount.

(b) Free offers cannot be retrospectively claimed. ie, a customer cannot claim a Special Offer that has been launched after their purchase.

(c) We might run out of stock of the item included in the Special Offer. If there is an alternative equivalent item in stock then it will be offered but this might not be possible in all circumstances. Please check with us in advance if this is a concern.

1.31 Law and Jurisdiction

These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
